TERMS OF SERVICE

1. Agreement to Terms

By accessing or using the Services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Our Service (What We Do / What We Are Not)

Smooth Sailing Technologies provides assistance in completing and preparing travel document applications, including Thailand's Digital Arrival Card (TDAC), based on the information you provide.

Important:

  • We are a private service provider and are not affiliated with any government.
  • We do not provide legal advice, immigration advice, or guarantees of approval.
  • You are responsible for ensuring your eligibility, travel readiness, and compliance with applicable rules.

3. User Responsibilities (Accuracy + Timing)

You agree that:

  • All information you provide is true, complete, and accurate.
  • You will review all details before submission.
  • You understand that inaccurate or incomplete information may cause delays, rejection, denial of entry, or other issues.
  • You are responsible for applying with sufficient time prior to travel.

4. No Guarantee

We do not guarantee:

  • Approval or acceptance by any authority.
  • Processing times, issuance times, or outcomes.
  • That the Services will be uninterrupted or error-free.

5. Fees, Taxes, and Payment

You agree to pay the fees presented at checkout, including any applicable taxes. Fees may include service fees and, if applicable, third-party processing fees.

If any government fee exists, you acknowledge that government fees (when applicable) are separate from our service fee and may be nonrefundable.

6. Chargebacks and Fraud Prevention

Unauthorized chargebacks, payment disputes, or fraudulent claims may result in:

  • Suspension of access to Services.
  • Collection efforts and recovery of costs and fees associated with the dispute where permitted by law.

7. Intellectual Property

The Services, content, branding, and software are owned by Smooth Sailing Technologies or its licensors and are protected by intellectual property laws. You may not copy, reverse engineer, or exploit the Services except as allowed by law.

8. Prohibited Uses

You agree not to:

  • Use the Services for unlawful purposes.
  • Provide false information, impersonate others, or submit documents you don't have rights to use.
  • Interfere with security or operation of the Services.

9. Third-Party Services

We may rely on third-party tools (payment processors, hosting, communications). We are not responsible for outages or errors caused by third parties.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Smooth Sailing Technologies WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR TRAVEL COSTS.

Smooth Sailing Technologies'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO Smooth Sailing Technologies FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE EVENT.

12. Indemnification

You agree to indemnify, defend, and hold harmless Smooth Sailing Technologies and its officers, directors, employees, contractors, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Information you provide that is false, inaccurate, incomplete, or unauthorized;
  • Your misuse of the Services;
  • Your violation of these Terms or applicable law.

13. Dispute Resolution; Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY.

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, not in court, except you may bring claims in small claims court if eligible.

No class actions: You and Smooth Sailing Technologies agree disputes will be brought only in your individual capacity, not as a plaintiff or class member.

Arbitration will be conducted under the rules of: JAMS in English.

Arbitration location: Wyoming, USA, unless required otherwise by law.

If this arbitration provision is found unenforceable, disputes will be resolved exclusively in the courts located in Wyoming, USA, and you consent to jurisdiction there.

14. Governing Law

These Terms are governed by the laws of Wyoming, USA, without regard to conflict-of-law principles.

15. Suspension and Termination

We may suspend or terminate access to the Services if we believe you violated these Terms, engaged in fraud/abuse, or created security risk.

16. Changes to Services or Terms

We may modify the Services and update these Terms. Continued use after updates constitutes acceptance.

17. Communications

You consent to receive communications electronically (email, website notices). These communications satisfy legal notice requirements.

18. Severability

If any provision is unenforceable, the remaining provisions remain in effect.
